Welcome to Fundle.ai – a digital loyalty and rewards engagement platform tailored for malls, retail chains, and consumer brands.

These Terms & Conditions (“Terms”) govern your access and use of Fundle.ai’s services, including our website, dashboard, APIs, and customer-facing touch points. By using our services, you accept these Terms in full. If you disagree with any part of the Terms, please do not use the platform.

1. Acceptance of Terms

By accessing or using our services, you agree to comply with these Terms and all applicable laws and regulations. If you are using Fundle.ai on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Use of the Platform

  • You agree to provide accurate and complete information for onboarding, store setup, and campaigns.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree not to misuse the platform, reverse engineer any part of the service, or engage in fraudulent campaign practices.

3. Data Ownership and Usage

  • All consumer data collected via QR code, WhatsApp, or in-store activation remains the sole property of the client.
  • ai acts as a data processor and will not share or sell customer information to third parties.
  • Aggregated and anonymized data may be used for performance insights and benchmarking.

4. Intellectual Property

All intellectual property related to the Fundle.ai platform, including software, logos, product names, and visual content, is owned by or licensed to Fundle.ai. You may not reproduce, distribute, or modify any content without written permission.

5. Subscription and Fees

  • Subscription fees and campaign costs are agreed upon in the service agreement or proposal shared with each client.
  • Failure to pay invoices within the stipulated timeline may lead to service suspension.
  • All fees are non-refundable unless stated otherwise in the cancellation policy.

6. Reward Fulfilment

  • ai enables both digital and physical reward issuance.
  • For physical gifts managed by the client, Fundle.ai is not responsible for delivery timelines or disputes.
  • Digital rewards are processed within 24-48 hours unless otherwise communicated.

7. Limitations of Liability

Fundle.ai shall not be held liable for:

  • Losses incurred due to incorrect customer data provided by the client
  • Downtime due to third-party services like WhatsApp or telecom providers
  • Indirect, incidental, or consequential damages related to the use of the platform

8. Termination

We reserve the right to suspend or terminate access if:

  • The platform is misused for illegal or deceptive practices
  • There is breach of payment terms or unauthorized use of services
  • Written termination is issued by either party with a 15-day notice

9. Governing Law

These Terms are governed by and construed in accordance with the laws of India. All disputes shall be subject to the jurisdiction of courts in New Delhi, India.
